Personal Data Processing Policy for Job Applicants

The company Slovak Telekom, a.s., with its registered office at Bajkalská 28, 817 62 Bratislava, ID No.: 35 763 469, registered in the Commercial Register maintained by the Municipality Court Bratislava III, Section: Sa, Insert No.: 2081/B, as the controller of personal data processing (hereinafter referred to as “Slovak Telekom”), has adopted this Personal Data Processing Policy for Job Applicants (hereinafter referred to as the “Policy”). The purpose of this Policy is to inform you, as a job applicant, about the manner and extent of the personal data processing and about the rights to which you are entitled. 

We always process your personal data transparently, fairly, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) and Act No. 18/2018 Coll., on Personal Data Protection, to the extent necessary for the respective purpose. To this end, we have adopted appropriate security measures. We retain personal data for the period strictly necessary in accordance with the retention periods imposed on us by individual legal regulations. 

  1. Types of Personal Data Processed

When you apply for our selection procedure, we process the following data about you: 

Identification and contact data: Name and surname, title, permanent residence address, temporary residence address, private email address, telephone number. 

Other personal data: This includes data you provide about yourself in the documents you send us, e.g., in a cover letter, your curriculum vitae (CV), or a motivation letter. The provision of this data is voluntary. 

Data on education and previous employment: Data on your education (e.g., list of completed schools, diplomas, certificates, completed courses), language skills, your skills, information about previous employment, driving licence, and other data you provide in your CV and motivation letter. 

Publicly available data: Information that is available on the internet, e.g., information listed in the Commercial Register, the insolvency register, or other legally permitted databases, if relevant. To a justified extent, international sanction and control lists or other sources may also be used, but always only to the necessary extent with regard to the given position. Furthermore, we are entitled to view your publicly available data on the social network LinkedIn. 

Data from our communication: This mainly includes our notes from telephone calls, notes from personal interviews (including online interviews), or our mutual written communication related to the given selection procedure. A recording of the interview may also be made for the purposes of the selection procedure – however, always exclusively with your knowledge and consent to the making of the recording and its further related processing, particularly its transcription and summarisation. 

Eligibility for the given position: You may be required to prove that you are legally eligible for the given position, e.g., through education, language skills, or that you are medically fit for selected types of positions. 

Declaration of a clean criminal record: Depending on the nature of the job position, we may ask you to submit a declaration confirming that you have not been convicted of any crime or misdemeanour (a current extract from the criminal record). 

CCTV footage: Our premises may be equipped with a CCTV system, which is clearly marked. The reason for the installation of the CCTV system is to ensure the protection of the rights and legally protected interests of our company and to ensure the safety of our employees, customers, and other persons entering our premises. A job applicant is always informed about the operation of the CCTV system by information signs at the entrance to the monitored area. 

In addition, depending on the position you are applying for, we may also obtain information from the following sources: 

Internal applications: If you already work for Slovak Telekom and are applying for an internal position, we may use information from your personnel file to supplement the information you provide in your job application. 

Assessments: We may ask you to undergo an assessment of your skills, personality, or cognitive abilities. Such assessments are usually carried out using third-party software or through a third-party company that shares the results with us. Before such an assessment is carried out, we will provide you with further information regarding your specific situation. 

References: We may decide to obtain references from persons who have worked with you in the past. We will only contact these persons if you provide us with their names and contact details. If you are already an employee of Slovak Telekom, we may request references from your manager and/or colleagues. 

Personal data processed in the event of your success in the selection procedure 

If you succeed in the selection process and we select you for the position in question, in addition to the data mentioned above, we are entitled, on the legal basis of performance of a contract (i.e., pre-contractual relations), to also obtain the following information from you: 

  • Personal details: for example, date of birth, birth surname, ID card number or other identity document number, personal identification number (rodné číslo), marital status, nationality, photograph, work permit, Social Insurance Agency identification number. 
  • Information about family members and dependants: e.g., name, surname, title, date of birth of a spouse or partner; name, surname, title, date of birth, personal identification number of your children. 
  • Information concerning remuneration, pension security, health security, and other benefits: e.g., name of the health insurance company, pension insurance, supplementary pension savings, bank name and account number, wage deductions. 
  • Information from an employment reference (references from persons with whom you have worked in the past) and a certificate of employment. 

We will process special categories of personal data only for purposes strictly related to the proper performance of our duties as your future employer, and only to the necessary extent required by the relevant legal regulations. 

We will process the following types of sensitive personal data: 

  • Data concerning your health: for example, a certificate of disability and health impairment of an employee, results of a preventive medical examination in relation to work, data on psychological and physical fitness for work. 
  • Extract from the criminal record: for selected job positions such as work with entrusted funds, cash, etc. 
  1. Legal Bases for Data Processing

Slovak Telekom informs you that, as part of streamlining the recruitment process for new employees, it processes your personal data for statistical purposes. The result of this is completely anonymised analyses. 

Processing of personal data based on your consent 

We process personal data based on your specific consent to the processing of personal data for the purpose of offering you other vacant job positions. As a job applicant, you have the option to consent to being included in the database of Slovak Telekom's partner company, T-Mobile Czech Republic a.s., ID No.: 64949681, with its registered office at Tomíčkova 2144/1, Chodov, 148 00 Prague 4. 

If you decide to subscribe to our Newsletters, we process your e-mail address. Slovak Telekom sends Newsletters concerning further career opportunities, i.e., employment at Slovak Telekom, and news in the human resources area. 

Processing of personal data without your consent: 

  • Legitimate interest: our legitimate interest consists in selecting the most suitable candidate for the vacant job position. 
  • Performance of a contract (conclusion of a contract): in the event of your success in the selection procedure, we are entitled to process your personal data on the basis of a pre-contractual relationship. 
  • Compliance with legal obligations: we are entitled to process your personal data to comply with obligations arising from the relevant legal regulations. 

Slovak Telekom will process your personal data for the following purposes: 

  • Recruitment of employees: We process your personal data to determine whether you are a qualified candidate for the position you are applying for. The legal basis is our legitimate interest and the performance of obligations from pre-contractual relations in which you act as one of the contracting parties. 
  • Resolution of potential disputes: We may process personal data for the purpose of resolving disputes, complaints, or legal proceedings. The legal basis is our legitimate interest and compliance with legal obligations defined by specific regulations. 
  • Sending HR Newsletters: We also process your e-mail address if you register to receive our Newsletters. Slovak Telekom sends Newsletters concerning further career opportunities, i.e., employment at Slovak Telekom, and news in the human resources area. You can unsubscribe from the Newsletter at any time by clicking the link we send in every Newsletter or by contacting us at the e-mail address: zamestnanie@telekom.sk. The legal basis is your specific consent. 
  1. Recipients and Processors of Your Personal Data

Your personal data is processed mainly by authorised employees of Slovak Telekom, and only to the extent necessary in the given case and in compliance with all security measures (including the duty of confidentiality). 

Slovak Telekom is entitled to share your personal data in the following cases: 

  • If we obtain information from third parties (as stated above), we will provide them with your name and any other necessary information required for them to provide us with relevant information about you. 
  • We may share your personal data with our contractual partners who act on our behalf, for example, with a service provider (so-called processors or recipients). In such cases, these third parties may use your personal data only for the purposes described above and only in accordance with our instructions. In the event that your personal data is processed by processors, we always conclude a respective data processing agreement with each processor. A significant processor is the company Profesia, s.r.o., ID No.: 35 800 861, with its registered office at Pribinova 19, Bratislava, Postal Code: 811 09, or T-Mobile Czech Republic a.s., with its registered office at Tomíčkova 2144/1, 148 00 Prague 4, with its sub-processor SCAUT, s.r.o., ID No.: 09296182, with its registered office at Inovační 122, 252 41 Zlatníky-Hodkovice. 
  • For the purpose of data processing, Slovak Telekom uses software tools from its business partner, the company recruitis.io s.r.o. However, the contractual partner does not have access to your personal data. 
  • If required by an applicable legal regulation or a court order, we may share your personal data, for example, with law enforcement authorities or other authorised bodies. 
  • In the case of a legitimate interest, we may provide your personal data to companies with an economic or personnel affiliation, but always only if there is a reason for such disclosure. 
  1. Location of Processing of Your Personal Data

The place of processing of your personal data is mainly the Slovak Republic, or other member states of the European Union. In the case of processing outside the territory of the European Union, this will be done exclusively to the necessary extent and under strict security standards and in compliance with all legal regulations, in particular on the basis of a European Commission adequacy decision (Article 45 of the GDPR) or the adoption of appropriate safeguards according to Article 46 of the GDPR. 

  1. Personal Data Retention Period

We retain your personal data for a limited time. We process your personal data on the basis of our legitimate interest for the duration of the selection procedure for the given position. Your personal data will be erased as soon as it is no longer needed for the given processing purpose. This means that we retain your data for the duration of the selection procedure in which we became acquainted with your personal data. The reason for this retention is the protection of our interests in the event of dispute resolution. If we select you for the position, we will retain your personal data in your personnel file, in accordance with our HR privacy policies. 

We may process your personal data for a longer period after the end of the selection process in the event of a potential legal dispute. 

If you grant us consent to be included in the database of job applicants, we process your personal data for a period of 2 years from the granting of consent. You can withdraw your consent at any time. In such a case, your personal data will be deleted. In the event of consent withdrawal, the data will be disposed of without undue delay. The withdrawal of consent is possible through standard communication channels, in particular directly to the DPO at ochrana.dat@telekom.sk. 

In the event of your entry into Slovak Telekom premises, for example for the purpose of a personal interview, CCTV footage may be created in the marked areas. We retain CCTV footage for a period of 15 days. 

  1. Rights of Data Subjects

If you ever decide to withdraw from the selection procedure before its conclusion by Slovak Telekom, you may do so and voluntarily delete your personal data via this address: https://app.recruitis.io/public/unsubscribe. 

Right of access You are entitled to a copy of the personal information we hold about you, as well as to certain information about how we use it. Your personal data will usually be provided to you in writing, unless otherwise requested, or if you have made the request by electronic means, the information will be provided to you electronically where possible. 

Right to rectification We take reasonable steps to ensure the accuracy and completeness of the information we hold about you. However, if you do not think this is the case, you can ask us to update or supplement this information. 

Right to erasure Under certain circumstances, you have the right to ask us to erase your personal data, for example, when the personal data we have collected is no longer necessary for the original purpose or when you withdraw your consent. However, this will need to be balanced against other factors. For example, we may have legal and regulatory obligations which mean we will not be able to comply with your request. 

Right to restriction of processing Under certain circumstances, you are entitled to ask us to stop using your personal information, for example, when you think that the personal information we hold about you may be inaccurate or when you think that we no longer need to use your personal data. 

Right to data portability Under certain circumstances, you have the right to ask us to transfer the personal data that you have provided to us to another third party of your choice. 

Right to object You have the right to object to processing that is based on our legitimate interests, which is the case here. Unless we have a compelling legitimate ground for the processing, when you lodge an objection, we will no longer process your personal data. Please note, however, that this means we can no longer consider your job application. 

Rights related to automated decision-making You have the right to object to automated decision-making, including profiling, which produces legal effects concerning you or similarly significantly affects you. ST does not usually use automated decision-making or profiling in the context of employment, but if you have been subject to an automated decision and you do not agree with the outcome, you can contact us using the contact details below and ask us to review the decision. 

Right to withdraw consent In most cases, we do not process your personal data on the basis of your consent. However, it may happen that in specific cases we ask for your consent. Where we do so, you have the right to withdraw your consent to the further use of your personal data.

We may update this Statement from time to time, and if we do, we will inform you at this location.
